Conditions for returning goods:
- The buyer acknowledges that, according to the provisions of Section 1837 of the Civil Code, it is not possible to withdraw from a purchase contract for the supply of goods that have been modified according to the buyer's wishes or for his person, from a purchase contract for the supply of goods that are subject to rapid deterioration, as well as goods that have been irretrievably mixed with other goods after delivery, from a purchase contract for the supply of goods in sealed packaging that the consumer has removed from the packaging and cannot be returned for hygienic reasons (e.g. mattresses and mattress protectors, pillows, blankets and bed linen, underwear, etc.) and from a purchase contract for the supply of audio or video recordings or computer programs if their original packaging has been broken.
- Unless the case referred to in the previous paragraph or another case where withdrawal from the purchase contract is not possible, the buyer has the right to withdraw from the purchase contract, in accordance with the provisions of Section 1829, paragraph 1 of the Civil Code, within fourteen (14) days from the receipt of the goods, and if the subject of the purchase contract is several types of goods or the delivery of several parts, this period runs from the date of receipt of the last delivery of goods. Withdrawal from the purchase contract must be sent to the seller within the period specified in the previous sentence. To withdraw from the purchase contract, the buyer can use the sample form provided by the seller, which is an annex to the terms and conditions. The buyer can send withdrawal from the purchase contract, among others, to the address of the seller's business premises or to the seller's e-mail address. In the event of withdrawal from the purchase contract according to this article of the GTC, the purchase contract is cancelled from the beginning. The goods must be returned by the buyer to the seller within fourteen (14) days of the delivery of the withdrawal from the purchase contract to the seller. If the buyer withdraws from the purchase contract, the buyer bears the costs associated with returning the goods to the seller, even in the event that the goods cannot be returned by regular mail due to their nature.
- In the event of withdrawal from the purchase contract according to this article of the GTC, the seller will return the funds received from the buyer within fourteen (14) days of the withdrawal from the purchase contract by the buyer, in the same way as the seller received them from the buyer, unless otherwise agreed with the buyer. The seller is also entitled to return the performance provided by the buyer when the goods are returned by the buyer or in another way, if the buyer agrees to this and no additional costs are incurred by the buyer. If the buyer withdraws from the purchase contract, the seller is not obliged to return the received funds to the buyer before the buyer returns the goods or proves that he sent the goods to the seller.
- The buyer acknowledges that the seller is entitled to unilaterally offset the claim for compensation for damage incurred on the returned goods against the buyer's claim for a refund of the purchase price.
- Together with the purchase price, the seller will also refund the buyer the shipping costs for transporting the goods to the buyer, in the amount of the cheapest type of transport listed on the seller's e-shop on the day of the order; with the exception of the cash on delivery fee of CZK 49, which is non-refundable. The buyer pays the costs of transporting the goods by the buyer upon withdrawal from the contract and is not entitled to demand their refund from the seller.
- In all cases of withdrawal under this paragraph, the buyer expressly acknowledges that payments for assembly or return of goods are not part of the shipping costs and will not be refunded to the buyer.
- If a gift is provided to the buyer together with the goods, the gift agreement between the seller and the buyer is concluded with a termination condition that if the buyer withdraws from the purchase agreement, the gift agreement regarding such a gift loses its effectiveness and the buyer is obliged to return the gift provided to the seller together with the goods.
- In the event that the buyer purchases the goods in connection with the subject of his business activity or within the framework of his independent exercise of his profession, the provisions of this article of the GTC do not apply (i.e. in such a case the buyer does not have the right to withdraw under this article of the GTC).
